Sunwood, Inc. sued the Club for nonpayment of a loan for $100,000 they claim was extended on September 24, 2018, and remains unpaid.
Even though the Club was already suing Carl L. Kennedy II in another case, on September 13, 2021, the Club filed a motion to add Carl L. Kennedy II as a “Third Party Defendant” in this case (which makes the Club a “Third Party Plaintiff” in this case).
On May 26, 2022, the Court issued a Final Summary Judgment AGAINST the Club (in favor of Sunwood) for $117,624.24 (including costs and interest to date) plus 4.25% interest from May 26, 2022, closing the case brought by Sunwood. On June 27, 2022, Bank of America acknowledged a Writ of Garnishment against the Club’s bank account. The Club’s Third-Party Complaint against Carl L. Kennedy II was eventually settled in Bankruptcy Court as noticed to this court on September 11 and 12, 2023.
