Legal Update VI: Watch the PBFC vs. Carl Kennedy Hearings

We admit to having a hard time keeping track of the filings and related hearings in the ongoing case where the Club is suing former Treasurer Carl L. Kennedy, II, ostensibly just to retrieve Club records that they claimed Carl no longer had any right to retain. There have been a number of potentially significant filings by both parties including:

Kennedy’s answers and response to requested documents, providing many, with his objections and requests the Club narrow other requests.
The Club’s motion that Kennedy be compelled by the court to provide better answers to their complaint and the documents they requested.
Kennedy issued a subpoena to Treasurer, Andrew Bilukha, ordering him to appear in court via Zoom at the hearing and produce certain documents on Tuesday, November 17, 2020 at 09:30.
The Club issued a subpoena to third-party Wendy Hausmann, Esq. to be deposed by private Zoom on Tuesday, December 8, 2020 at 10:00. The record suggests that Ms. Hausmann did some work as an attorney for the Club during Kennedy’s tenure and that she temporarily represented Kennedy during one or more brief periods in this case.
There may be other matters discussed at the hearing on Nov 17, 2020 09:30. Specific identification is difficult because some matters previously scheduled for hearing appear to be unresolved and some other referenced pleadings do not appear in the docket.

As we previously expressed, it is unclear what constructive effect any of this can possibly have on the viability of the Club. During a period when the Club has claimed poverty, it is running up bills for what is certainly tens of thousands of dollars in attorney’s fees.
