Pompano Beach Flying Club Legal Update IV

This newsletter includes an update on current litigation related to the Club’s lawsuit
against former Treasurer (and current member) Carl L. Kennedy, II, and the Hills vs. the
Club. The latter case appears to be winding down (see report below), so we will begin
with an update on the Kennedy case. Summaries and a complete set of all filings for both
cases are available on the Litigation
page on our web site. Although we have not
completed an exhaustive search, these two cases appear to be the only current cases
where the Club is a party. If anyone knows of any new cases that have been filed in
which the Club is a party, please let us know the details.
Pompano Senior Squadron Flying Club, Inc. vs Carl L. Kennedy, II:
- The Club is suing former Treasurer Carl Kennedy, ostensibly only seeking
Club records he maintained when he was Treasurer, but also demanding records
he was never responsible to maintain, and others that are distributed or
published for all members.
- As we reported in our last newsletter, while the court record indicated
there would be a hearing on Tuesday, November 3, 2020 at 08:45 a.m., this
hearing was postponed.
- There have been a number of recent filings, pleadings, and
a subpoena
in the case which you can see on
the case page on
our web site.
- The next hearing is on Tuesday, November 17, 2020 from 9:30 a.m. to 10:00 a.m.
- This will be a public hearing held via Zoom (the Zoom link for each will
be on the case page on our web site the day before the hearings).
Lloyd
D Hill and Graham D Hill vs Pompano Senior Squadron Flying Club, Inc.:
- The Hills sued the Club in Broward County Small Claims Court primarily seeking
their refund of the $1,700 refundable membership fee after Graham withdrew in May.
- The trial was convened via Zoom on October 28, 2020 at 9:00 a.m.
- The judge began the administrative steps before trial by identifying all
individuals in the Zoom conference and segregating those identified as witnesses
and giving instruction to the remaining observers.
- The judge then asked if the parties would like to try make one final attempt to
settle the case before trial. Both parties agreed to try and were put into a separate room.
- About 20 minutes later, the parties returned and reported they had reached a
confidential settlement.
- We are awaiting the filings and orders that will formally close this case.
