Pompano Beach Flying Club Legal Update II

While this newsletter includes an update on the Club’s lawsuit against former Treasurer (and current member) Carl Kennedy, the Hills v. PBFC case is listed first below because that trial is scheduled for this coming Wednesday, October 28th, at 9:00am.
As we said on Tuesday, Club members may not have been informed that a large amount of their dues are currently being spent to pay an attorney untold sums against current and former members in Broward County Courts. Summaries and a complete set of all filings for both cases are available on the Litigation page on our web site. All hearings that are open to the public are viewable by Zoom from the comfort of your home. Please review the updates below for the latest information:
Lloyd D Hill and Graham D Hill vs Pompano Senior Squadron Flying Club, Inc.:
- The Hills are suing the Club in Broward County Small Claims Court primarily seeking their refund of the $1,700 refundable membership fee after Graham withdrew in May.
- The Hills are representing themselves “pro se” (no attorney) but the Club is paying untold sums for defense by the same attorney they are using to sue Mr. Kennedy.
- The parties have filed their witness and exhibits (see the complete docket for filings):
- The Hills have identified about 40 exhibits and two witnesses (plus themselves):
- Former Club President Larry Mellgren
- Former Club Director Robert Hannan
- The Club has identified about 10 exhibits and two witnesses:
- Club President Greg Gilhooly
- Club Treasurer Andrew Bilukha
- The Trial Begins on Wednesday, October 28, 2020 at 9:00 a.m.
- This is a public trial and will be held by Zoom (the Zoom link is on our web site).

Pompano Senior Squadron Flying Club, Inc. vs Carl L. Kennedy, II:
- The Club is suing former Treasurer Carl Kennedy, ostensibly only seeking Club records he maintained when he was Treasurer, but also demanding records he was never responsible to maintain, and others that are distributed or published for all members.
- Carl Kennedy recently filed a counter-complaint alleging, among other things, that the club is wasting dues money on frivolous litigation.
- Both parties withdrew their notices of hearing for motions previously scheduled for October 22, 2020. However, since then:
- These will be public hearings and will be held by Zoom (the Zoom links will be on the case page on our web site as the dates draw closer).
